BACK TO THE STARTING POINT

On May 8 the Chamber for Civil and Commercial Cases of the RA Court of Cassation secured the claim of "Dar 21", "ARMENAKOB", "TV 5", "Yerevan" and "EV" versus the National Commission on Television and Radio. As it has been reported, five TV companies challenged with the supreme judicial authority the resolution of the Commercial Court dismissing the demand of the broadcasters to the National Commission to return the applications for broadcast licensing competition for revision. At the hearings of the RA Court of Cassation that started on April 25 the parties were to consider the feasibility of reconciliation (see YPC Weekly Newsletter, April 25 – May 1, 2003). This possibility was discussed on May 6 by National Commission, the plaintiffs and "A1+" and "Noyan Tapan" TV companies, also taking part on the licensing competition. However, no agreement was reached.

According to the decision of the Court of Cassation, the case is redirected to the Commercial Court for reconsideration. And the chance of the "A1+", deprived of air for over a year already, is again delayed for indefinite period of time.
