On November 7, the hearings on the suit of “A1+” founder “Meltex” LLC versus the National Commission on Television and Radio continued in RA Commercial Court (see YPC Weekly Newsletter, October 31 – November 6, 2003). As it has been reported, the suit brought on September 29 contained the demand to oblige the National Commission to give concrete explanations why according to the results of voting on July 18, 2003 “A1+” TV was refused a broadcast license. Later “A1+” founder filed second suit of similar nature. In this case, the suit was related to another broadcast licensing competition the results of which were summed up on June 11. Here also “A1+” bid was assessed by the National Commission lower than that of its rival (see YPC Weekly Newsletter, June 6-12, 2003). Both suits were united into one legal action.
At the session, the plaintiff substantiated his position according to which the refusal by the National Commission to grant “A1+” written explanations violates the legislation in force. The defense forwarded a petition on providing sufficient time for additional evidence. The court met the motion and scheduled the next session for November 26.
