On January 9, the fist session of the RA Commercial Court on the suit of “Meltex” LLC, the founder of “A1+” TV company, versus the National Commission on Television and Radio demanding to annul the decision of the National Commission on granting a broadcast license to “Cinemax” LLC. As it has been reported the plaintiff challenges the voting results of October 13, 2003, according to which “Cinemax” was named a winner of the competition for the use of 63rd UHF of Yerevan. “A1+” TV company, having also taken part in the competition believes that the application of “Cinemax” (broadcasts the programs of “EuroNews” TV channels and the programs of “ArmNews” TV company) contained false information (see YPC Weekly Newsletter, December 19-25, 2003).
At the session the founder of “A1+” was given the written response of the National Commission. The next session is appointed on January 21, and during this time the plaintiff is to review the arguments of the respondent.
On December 29, 2003 at the same Commercial Court the hearing on another suit of “A1+” versus the National Commission on Television and Radio continued. This time the dispute was focused on other broadcast licensing competition, the voting for which was held on June 11 and July 18 last year (see YPC Weekly Newsletter, November 7-13, 2003). The founder of “A1+” demands to commit the National Commission to presenting the specific grounds for refusing a broadcast license to the company as a result of these competitions.
At the session the representative of the respondent filed a motion to summon the “A1+” management to the process as witnesses, which was declined.
