On February 6 in Yerevan a press-conference of attorney Nerses Harutiunian
was held. The attorney defends the interests of Martun Ivanian in a case versus
the founder of “Pakagits” daily, “Agap-Hrat” LLC. As it has been announced at
the press-conference, on December 14, 2006 the court of primary jurisdiction
of Erebuni and Nubarashen communities of Yerevan committed “Agap-Hrat” to repaying
the debt of 9.048 million drams (over $ 25,000) to Martun Ivanian. The debt
was formed through unmet contractual liabilities. As reported, the financial
claims to “Pakagits” founder for 8.5 million drams (about $ 22,000) were first
put forth in October 2006 by Daniel Tanian. As а pre-award relief, the court
of Erebuni and Nubarashen communities resolved to arrest the property of “Agap-Hrat”.
On November 9 representatives of the RA Service of Compulsory Execution of Court
Acts visited “Pakagits” editorial office and took away the property, which,
however, was returned on the same day. On November 14 “Pakagits” reported that
Daniel Tanian is a board member of “Democracy and Labour” party that used to
lease its premises to “Agap-Hrat”. The newspaper also published Tanian’s written
confirmation that “Agap-Hrat” does not owe him the amount noted above (see YPC
Weekly Newsletter, November
10-16, 2006).
According to lawyer Nerses Harutiunian, Daniel Tanian transferred his competence
to the new plaintiff, Martun Ivanian. On December 14, 2006 the court of primary
jurisdiction of Erebuni and Nubarashen communities committed “Agap-Hrat” to
pay the debt that had increased by the time. The court ruling has come into
force, the attorney noted; however, to this day “Agap-Hrat” has not repaid the
debt.
On the same day, February 6, representative of Compulsory Execution Service
visited the editorial office of “Pakagits” and, as the newspaper report on February
7, 2007, once more made a property inventory. In the next issue, on February
8, 2007, “Pakagits” informed that the day before the compulsory executors visited
“Gind” publishing house, where the newspaper is printed, asking where the editorial
office gets money to pay for publishing services.
