"NOYAN TAPAN" VERSUS THE NATIONAL COMMISSION ON TELEVISION AND RADIO: THE COURT OF CASSATION LEFT THE DECISION OF THE PRIMARY JURISDICTION BODY UNCHANGED

On July 12 the Chamber of Civil and Commercial Cases of the RA Court of Cassation did not secure the claim of "Noyan Tapan" LLC versus the National Commission on Television and Radio. As it has previously been reported, "Noyan Tapan" challenged the decision by the RA Commercial Court of May 24 with the Court of Cassation (see YPC Weekly Newsletter, June 29 – July 5, 2002).

Thus, both the first and the supreme jurisdiction court authorities rejected the demand of the plaintiff to annul the broadcast licensing competition results that were announced by the National Commission on April 2, 2002. After the competition "Noyan Tapan" and "A1+" TV companies were not granted broadcast licenses.

According to the General Director of "Noyan Tapan" Tigran Haroutiunian, their organization intends to challenge these decisions with the European Court of Human Rights.
